This radical analysis of the role and importance of historiography interprets the philosophy and theory of history on the basis of historicity as a human condition. The book examins the norms and methods of historiography from a philosophical point of view, but rejects generalisations tht the philosophy of history can provide all the answers to contemporary problems. Instead it outlines a feasible theory of history which is still radical enough to apply to all social structures.

Agnes Arber's international reputation is due in part to her exceptional ability to interpret the German tradition of scholarship for the English-speaking world. The Mind and the Eye is an erudite book, revealing its author's familiarity with philosophy from Plato and Aristotle through Aquinas to Kant and Hegel; but it is not dull, because the quiet enthusiasm of the author shines through. In this book she turns from the work of a specialist in one science to those wider questions (...) which any scientist must ask at intervals. What, in short, is the relationship between the eye that sees and the mind that weighs and pronounces? An important feature of this Cambridge Science Classics reissue is the introduction provided by Professor P. R. Bell, who as a Cambridge botany student at the time that Agnes Arber was writing The Natural Philosopby of Plant Form, is uniquely able to set The Mind and the Eye in the context of contemporary biological research. Aspiration by Agnes Callard locates standing assumptions in the theory of rationality, moral psychology and autonomy that preclude the possibility of working to acquire new values. The book also explains what changes need to be made if we are to make room for this form of agency, which I call aspiration.

This two-part paper is about the possibility of analyzing the content of chemistry from a gender perspective. The first part provides an example of what such an analysis would look like. The second part is an outline of the theoretical perspective that makes the analysis possible. The example is the model of the ideal gas, the cornerstone of the theory of matter in chemical thermodynamics. I argue that this model is built on fundamental philosophical assumptions (Platonic idealism, hierarchy among states (...) of matter, atomism/individualism, and the negligence of interrelationships among parts and of their embodiment) that have been problematized by feminist scholarship. The same patterns are evident in the treatment of ideal and real solutions in chemical thermodynamics. I argue that it is possible to imagine a theory that utilizes different philosophical ideas and which therefore would be more compatible with feminist values. (shrink)

Gliomas can display marked changes in the concentrations of energy metabolism molecules such as creatine (Cr), phosphocreatine (PCr) and lactate, as measured using magnetic resonance spectroscopy (MRS). Moreover, the BOLD (blood oxygen level dependent) contrast enhancement in functional magnetic resonance imaging (fMRI) can be reduced or missing within or near gliomas, while neural activity is not significantly reduced (so-called neurovascular decoupling), so that the location of functionally eloquent areas using fMRI can be erroneous. In this paper, we adapt a previously (...) developed model of the coupling between neural activation, energy metabolism and hemodynamics, by including the venous dilatation Balloon model of Buxton and Frank. We show that decreasing the cerebral blood flow (CBF) baseline value, or the CBF increase fraction, results in a decrease of the BOLD signal and an increase of the lactate peak during a sustained activation. Baseline lactate and PCr levels are not significantly affected by CBF baseline reduction, but are altered even by a moderate decrease of mitochondrial respiration. Decreasing the total Cr and PCr concentration reduces the BOLD signal after the initial overshoot. In conclusion, we suggest that the coupled use of BOLD fMRI and MRS could contribute to a better understanding of the neurovascular and metabolic decoupling in gliomas. (shrink)

Many appraisal theories claim that appraisal causes emotion. Critics have rejected this claim because they believe (a) it is incompatible with the claim that appraisal is a part of emotion, (b) it is not empirically supported, (c) it is circular and hence nonempirical, and (d) there are alternative causes. I reply that (a) the causal claim is incompatible with the part claim on some but not all interpretations of the causal claim and the part claim, (b) the lack of empirical (...) support can be remedied, (c) there may even be ways to cope with the circularity problem, and (d) it is unclear to what extent the alternative causes differ from appraisal. Feminist science criticism has mostly focused on the theories of the life sciences, while the few studies about gender and the physical sciences locate gender in the practice, and not in the theories, of these fields. Arguably, the reason for this asymmetry is that the conceptual and methodological tools developed by (feminist) science studies are not suited to analyze the hard sciences for gender-related values in their content. My central claim is that a conceptual, rather than an empirical, analysis is (...) needed; one should be looking for general metaphysical principles which serve as the conceptual foundation for the scientific theory, and which, in other contexts, constitute the philosophical foundations of a worldview that legitimates social inequalities. This position is not being advocated anywhere in the philosophy of science, but its elements are to be found in Helen Longino's theory of science, and in the social epistemology and ontology of Georg Lukács. Contract theories may be a useful analytical tool for understanding and explaining contract, as well as for facilitating orientation in a complex and often fragmented legal regulation. The article presents main understandings of contract in various European jurisdictions: contract as free assumption of obligation, contract as a bargain based on the idea of consideration, contract as free assumption of obligation based on sufficient causa. The article inquires as to how universal those theories are, what are the recent trends in the (...) development of European contract law, what philosophy of contract underlies the soft law instruments, such as UNIDROIT Principles of International Commercial Contracts or Principles of European Contract Law (PECL), what is the stance of the Draft Common Frame of Reference (DCFR) in regard to the concept of contract. Under the law of Lithuania the definition of contract comprises elements found in several European countries, but it is argued that the new Lithuanian Civil Code has not received any model in its pure form. However it seems that the prevailing view understands contract as juridical act, as freely assumed obligation and meeting of parties’ intentions with the aim to create legal effects. Following the position of soft law instruments in regard to the elements of the contract, Lithuanian law (at least in its statutory form) does not have any explicit additional requirements, such as consideration or causa. In this essay I want to show that while the concept of autonomy can hardly make a meaningful contribution to the understanding of contemporary artworks, the concept of the dignity of artwork can make such a contribution.

The aim of this article is to address the regulatory framework as one of the key factors determining the success of creation of single market for renewable energy. No one could possibly argue that non-discriminative and consistent legal regulation plays a big role in the creation of a single market. Therefore, the question of legal capability to create the single market for renewable energy and the overall quality of present regulatory framework is at the centre of this article. Our objective (...) is to analyse whether the single market for energy produced from renewable sources can be created under current legal regulation of the European Union Therefore, the first part of the article analyses the competence of the European Union to regulate the renewable energy sector and division of legislative powers between the Member States and the European Union. The goal of the first part is to answer the question whether the European Union has the competence to regulate renewable energy market. The second part of the article analyses the legal framework of measures for the promotion of renewable energy production used in each Member State. The goal of the second part of this article is to answer the question – whether all renewable energy producers are in equal competitive position, notwithstanding different legal frameworks of the Member States. Many views define the concept of automaticity in terms of a number of features, but they differ with regard to the features they put most emphasis on, as well as with regard to the coherence they assume among the features. One contemporary account is the gradual and decompositional view, which proposes to investigate each automaticity feature separately and determine the degree to which it is present. The tension between liberalism and democracy is very likely to become one of the major confliction fields of the early twenty-first century. Those conflicts include the redefinition of the relationship between ethics, morality, and law—in all the three spheres of modernity: the intimate, the private and the public. It turns out that all three aspects of the relationship once described by Hegel (law, morality and Sittlichkeit) remain equally decisive to maintain or regain the balance of freedoms in the modern world. Law—in this context—is not just the defender of the “universal” aspect, but preferably also that of the balance of freedoms (both through interfering, and through the denial of interference in “ethical life”). Ayahuasca has become a subject of great interest in recent years. Academics, spiritual seekers, communities, and curious individuals have all been intrigued by this topic through either writing about it or direct participation in the contemporary spiritual phenomenon that is ayahuasca, which holds promises of bestowing upon its users profound wisdom or healing. However, what anthropological (but also popular) writings barely comment on are the deviant perceptions that arise out of experiences seeking amelioration or transcendence, and the subjective ways in (...) which those experiences are interpreted. Consequently, I wish to supplement this scope of representation. In this text, I present fieldwork conducted in the Peruvian Amazon amid the Shipibo, focusing on the experiences of the spiritual seekers who came to them in search of healing or self-discovery. I discovered a unique contradiction—participation in Shipibo ayahuasca practices while simultaneously having or developing a negative perception or attitude towards it. These aberrances are held, as I argue herein, (incognizantly) in the expressed attitudes of the Westerners (especially North American and European) as a result of the positivist notions that emerged from the Age of Enlightenment (but are not limited to it). My priority in this article is to present and expound on these atypical associations and place them against a historical (Western) background to elucidate the origin of the thus found and experienced perceptions. With reference to the Dutch model, which has been adopted by the Lithuanian Civil Code, the possibility to renounce Investigation Proceedings in the Articles of Incorporation or shareholder agreements is analysed in this article. The mandatory nature of the Investigation Proceedings is derived from the provisions of the Code, mainly: from an active role of the court, typical to the cases with the element of public interest, from specific rules for protecting the public interest in the course of the Investigation (...) Proceedings, also taking into account statutory duties of managers, the scope of which may not be narrowed by SHA, and the fact, that the Investigation Proceedings is generally designated to be an instrument to safeguard the interests of minority shareholders against the abuse of their rights by the company, and, finally, acknowledging the extraordinary nature of remedies available in the Investigation Proceedings. This book details the history of the concept of the beautiful, starting with a distinction between the 'warm' metaphysics of beauty and the 'cold' one modeled on Plato's Janus-faced relationship to beauty, and ending with a fragmented yet hopeful vision propagated by the likes of Nietzsche, Benjamin, and Adorno. The most important intellectual figures to write about beauty in Western metaphysics and in the post-metaphysical age are examined in this book.

Modern medicine provides unprecedented opportunities in diagnostics and treatment. However, in some situations at the end of a patient’s life, many physicians refrain from using all possible measures to prolong life. We studied the incidence of different types of treatment withheld or withdrawn in 6 European countries and analyzed the main background characteristics.

Adaptors are proteins of multi‐modular structure without enzymatic activity. Their capacity to organise large, temporary protein complexes by linking proteins together in a regulated and selective fashion makes them of outstanding importance in the establishment and maintenance of specificity and efficiency in all known signal transduction pathways. This review focuses on the structural and functional characterisation of adaptors involved in tyrosine kinase (TK) signalling. TK‐linked adaptors can be distinguished by their domain composition and binding specificities. However, such structural classifications have (...) proven inadequate as indicators of functional roles. A better way to understand the logic of signalling networks might be to look at functional aspects of adaptor proteins such as signalling specificity, negative versus positive contribution to signal propagation, or their position in the signalling hierarchy. All of these functions are dynamic, suggesting that adaptors have important regulatory roles rather than acting only as stable linkers in signal transduction. I present an overview of emotion theories, organised around the question of emotion causation. I argue that theories of emotion causation should ideally address the problems of elicitation, intensity, and differentiation. Each of these problems can be divided into a subquestion that asks about the relation between stimuli and emotions (i.e., the functional level of process description, cf. Marr, 1982) and a subquestion that asks about the mechanism and representations that intervene (i.e., the algorithmic level of process description). The overview (...) reveals that theories of emotion causation sometimes differ with regard to the kind of process that they hold responsible for emotion causation. More precisely, they hold different assumptions regarding the conditions under which the process is supposed to operate (optimal versus suboptimal), the format of the representations involved (propositional versus perceptual), and the object or input of the central process (stimulus versus responses/experience). Further, the overview reveals that theories of emotion causation sometimes differ with regard to the level of process description that they focus on. Appraisal theories of emotion have two fundamental assumptions: (a) that there are regularities to be discovered between situations and components of emotional episodes, and (b) that the influence of these situations on these components is causally mediated by a mental process called appraisal. Appraisal theories come in different flavors, proposing different to-be-explained phenomena and different underlying mechanisms for the influence of appraisal on the other components.

The debate about the nature of modernity and postmodernity has become central to intellectual culture today. In this work, two distinguished social theorists make a distinctive contribution to this continuing discussion.

This article analyses that state responsibility in international law is contractual liability, as a state infringes its obligations to another state (states), stemming out of international law. Member State liability in damages to a private party for breach of European Union law is, contrarily, non-contractual liability to a private party. Having analysed the elements of internationally wrongful act, it is stated that the elements of internationally wrongful act can be used to determine the elements of breach of the European Union (...) law. Thus if an international court declares that a state committed an internationally wrongful act, it would be possible to maintain that the elements of breach of the European Union law are met as well. The author of this article notes that it is very important to identify a particular state institution, which has infringed the European Union or international law, as not attributing to the state the acts of the state institution under the European Union or international law, there should be no possibility to apply state liability in damages to a private party for breach of the European Union law or state responsibility in international law – the state can be liable only for acts of its institutions. This article also analyses the cases where application of both Member State’s liability in damages to a private party for breach of the European Union law and state responsibility in international could be possible. In such case a private party can suffer damages if a Member State breaches an international agreement, concluded by the European Union, imposing particular obligations on that Member State. Therefore, it is ascertained that a private party should not have to prove the second condition of liability – sufficient seriousness of the breach1 – if an international court foremost states that a Member State commited an internationally wrongful act – breached its obligation arising out of an international agreement entered into by the European Union. Such an infringement would be considered to be as sufficiently serious per se. (shrink)

The acquisition of complex motor, cognitive, and social skills, like playing a musical instrument or mastering sports or a language, is generally associated with implicit skill learning . Although it is a general view that SL is most effective in childhood, and such skills are best acquired if learning starts early, this idea has rarely been tested by systematic empirical studies on the developmental pathways of SL from childhood to old age. In this paper, we challenge the view that childhood (...) and early school years are the prime time for skill learning by tracking age-related changes in performance in three different paradigms of SL. We collected data from participants between 7 and 87 years for a Serial Reaction Time Task testing the learning of motor sequences, an Artificial Grammar Learning task testing the extraction of regularities from auditory sequences, and Probabilistic Category Learning in the Weather Prediction task , a non-sequential categorization task. Results on all three tasks show that adolescence and adulthood are the most efficient periods for skill learning, since instead of becoming less and less effective with age, SL improves from childhood into adulthood and then later declines with aging. This article analyses the legal basics of the Member States liability in damages for the breach of European Union law and the conditions for liability. It is emphasized that the Member States liability in damages for the breach of European Union law has three different grounds—one direct legal background (Article 4 of the Treaty of the European Union) and two indirect basics—principles of direct effect and that of effectiveness of European Union law. The author subsequently examines the content of each (...) condition for liability established in the practice of the Court of Justice of the European Union —the intention of the rule of European Union law infringed to confer rights on private parties, the sufficiently seriousness of the breach and the direct causal link between the breach and the damage. It is stated that in order to prove that a Member State is liable for the breach of European Union law, one more condition for liability should be established—a private party must prove that he has incurred particular damage. It is also highlighted that the second condition for the Member States liability in damages for the breach of European Union law —sufficiently seriousness of the breach—restricts the right of a private party to obtain compensation. Standard dual-process models in the action domain postulate that stimulus-driven processes are responsible for suboptimal behavior because they take them to be rigid and automatic and therefore the default. We propose an alternative dual-process model in which goal-directed processes are the default instead. We then transfer the dual- process logic from the action domain to the emotion domain. This reveals that emotional behavior is often attributed to stimulus-driven processes. Our alternative model submits that goal-directed processes could be the primary determinant (...) of emotional behavior instead. We evaluate the type of empirical evidence required for validating our model and we consider implications of our model for behavior change, encouraging strategies focused on the expectancies and values of action outcomes. Horizons is a critical inventory of value-related thinking, demonstrating that the mind has the ability to profile a distinctive circumstance in diverse ways. Readers are first invited to a historical inquiry into typical configurations of values, their collisions, and the worldviews that drive them. They are then introduced to the epistemologies employed by the social sciences, so that they are better able to gauge the potential of these disciplines for coming to terms with values. Axiology is portrayed as a field (...) that has broken free from its neo-Kantian roots, benefiting from challenging new conceptual frames based in documents with global reach-mainly the United Nations Universal Declaration of Human Rights. After scrutiny of what various sociological models claim about values and the way in which empirical surveys approach them, Horizons reaffirms the assumption that social life and its dynamics condition the fate of values. Yet, for the sake of more accurate accounts, research should consider to a greater extent social stratification, and pressing macrosocial problems such as environmental protection, sustainable development, and attainment of some form of global equity. Social sciences' limitations modulate their ability to serve as an unequivocal guide for value choices. These limitations are a problem because of the significance of the process of dialogue and deliberation in value-related fields. Rather than advancing the allegedly universal characteristics of any one culture, in a world consisting of many civilizations, the imperative is to acknowledge pluralism and discern what is held in common. Freud, Psychoanalysis and Symbolism offers an innovative general theory of symbolism, derived from Freud's psychoanalytic theory and relocated within mainstream scientific psychology. It is the first systematic investigation of the development of Freud's treatment of symbolism throughout his published works, and discovers in those writings a broad theory which is far superior to the widely accepted, narrow, 'official' view. Agnes Petocz argues that the treatment of symbolism must begin with the identification and clarification of a set of logical constraints (...) and psychological requirements which any general theory of symbolism must respect, and that these requirements have been neglected by existing accounts across a number of disciplines. Her newly proposed 'Freudian broad' theory of symbolism, by contrast, does meet these requirements, but only after it has been rehabilitated within a revised psychoanalytic context, encompassing major changes to our understanding of the concepts of unconscious and repression and the role of language. Written by one of the most influential figures in post-World-War-II social thought, _A Theory of Modernity_ is a comprehensive analysis of the main dynamics of modernity, which discusses the technological, social and political elements of modernism.

The target article inventories mechanisms underlying musical emotions. We argue that the inventory misses important mechanisms and that its structure would benefit from the distinction between two types of musical emotions. We also argue that the authors' claim that appraisal does not play a crucial role in the causation of musical emotions rests on a narrow conception of appraisal.

This paper is based on the findings of my PhD research into at the effect of participation in the Roman Catholic Sacrament of the Eucharist on the formation of subjectivity viewed from the perspective of Feminist Liberation Theology. Taking Eucharist as a communal manifestation of belief in communion with the divine celebrated through symbolic liturgical enactments of thanksgiving and praise I am exploring the link between Feminist Relational Theologies and new findings in Cosmology and Quantum Theology that highlight interdependence and (...) relationality as basic to our understanding of ourselves and the nature of the divine. Subsequently the contribution of these theologies that offer the possibility of a more expansive and inclusive interpretation of the meaning transmitted by the symbols used in Eucharistic gatherings might provide a space where the indwelling of the divine in all its diverse manifestations can be recognized and celebrated.
